The simple answer to this somewhat complicated question is yes a CCJ can be legally removed.
So then, "why is it a complicated question?" you may ask. Well there are a number of reasons for this, which involves contacting the courts, finding one of the many reasons why CCJ removal may be applicable to you and your circumstances and then getting your voice heard.
There are many companies in the UK right now who offer a credit repair service which may include removing CCJ's from your credit file. The majority of these companies quite frankly are not worth dealing with and are to say the least lacking in any great degree of substance.
I you get a decent credit repair company to deal with the removal of your CCJ they will in almost all cases follow the following process.
1. They will take your basic details such as name, address, contact numbers, and date of birth.
2. They will then ask you in your own words to describe what happened to cause the judgement to be registered. They will interrupt you at various times during your tale, to dig down into relevant detail such as dates, correspondence which may or may not have been received, amounts and details of court references and plaintiff details.
3. They will then assess whether your judgement has grounds to be removed.
4. They will then ask you to pay their fee into a bank account or to send a cheque for payment (usually £97-£125 per judgement).
5. On receipt of your fee they will translate your story onto the relevant court forms, pointing out the grounds upon which they are applying to have the judgement removed.
6. The forms will then be sent to you along with an affidavit which will need to be witnessed by a solicitor, at a cost of around £5.00. The affidavit is your statement of truth and carries great weight with the courts. Please do not be tempted to short cut this part of the process.
7. You will then need to return the paperwork to the credit repair company so that they can forward this to the court with their submission letter.
8. The courts the take about 28 days to process the matter and you may be required to attend court to present your case. Unless you pay an additional fee for legal representation then your credit repair company usually will not attend. Their business is to find the grounds on which you qualify for CCJ removal and to present your paperwork to the court in the best manner possible.
Whilst their is never a guarantee that the courts will remove the judgement for you, their are 13 main areas where the system and procedures are breached on a regular basis and your credit repair company will know each and every one of these.
It is remarkable just how many CCJ's can be legally removed; it is even more remarkable that so many go uncontested, so many in fact that the government set up the CCJ bulk centre at Northampton to deal with finance cases as so many are undefended.
